Abstract

The Brazilian Executive Branch has presented to the Congress a bill involving guarantee rights. The purpose of such bill is to establish a new framework to ensure that debtors’ liabilities are met. Notwithstanding the alleged purposes, the paper advocates that such bill shall not pass due to flaws involving legislative initiative and the bill’s content by itself.
