The distinction between “juridical acts” and “juridical facts” in Brazilian Private law

Reflecting the country’s legal history, the 2002 Brazilian Civil Code is one of the few civil codes in the world with a General Part heritage of the influence of German authors, and a comprehensive regulation of “juridical acts” and “juridical facts”, both fundamental legal concepts for private lawyers. As there is a renewed interest among French scholars for these concepts, recently enshrined in the French Civil Code, this paper addresses the origins of the distinction made between “juridical acts” and “juridical facts” and sheds some light on the profound diferences between their meaning under French, German and Brazilian law.
