The works of some Brazilian legal scholars as well as precedents from the Brazilian higher court (Superior Tribunal de Justiça) have argued the possibility of mixing different species of non-economic damages related to personal injury, such as cosmetic damages. The present paper, on the other hand, proposes a different approach on the concept of damages, considering the distinction between damages as violations of legal duties and damages as losses resulting from personal injury.
