Abstract

Non-statutory contracts are an important device to fulfill the parties’ interests. Differently from the statutory contracts, which have ordinary rights and duties established by statutory law, these contracts are located in the domains of pure contractual freedom, where parties declare special interests, differing from the regular statutory scheme. These peculiarities affect the way these contracts shall be analyzed to be interpreted and integrated, in order to favor the parties’ intention with the contract.
