Commercial law in classical Rome: revisiting paradigms
Keywords:
Roman law, Commercial law, Company, Company elements, Classical Roman lawAbstract
The paper presents an issue that has been debated for a long time, which is whether there has been a sort of Commercial Law during the historical years of Roman Law. The text presents scholarly theories for reference, such as classical ones that usually advocate for the non-existence of such legal body in Classical Rome. In this sense, the paper adopts a modern revisionist approach and, for this regard, prioritizes revisionist theories that pave the way for its verification in a critical sense.
