The public policy as an exception in cr oss-board insolvency matters: an analysis of a Hong Kong Court’s Decision

Brazil internalized UNCITRAL’s Model Law through Brazilian Act 14,112/2020. Such act has, among other objectives, the scope of cooperation between courts that deal with insolvency of cross-board companies. Under the rules established on the act, there is an exception of public policy, which enables a Brazilian judge to find a foreign insolvency lawsuit inadmissible in case it is manifestly contrary to public policy. In this sense, this paper analyses a Hong Kong Court’s decision based on this exception, while the paper also tries to identify whether there is in Brazil an applicable rule or not for this situation.
