Abstract

This paper aims to synthetically present the partnership contract (societas) in roman law, through a portray of some of its aspects and fundamental characteristics. To that end, this work covers the general lines of the societas, presenting the problematic and thesis about its origin as a consensual contract. After that, it is introduced the issue of the partnership social object and its reflections on the requisites of economic purpose and legality. It is debated the problem of the obligation contribution of capital and the one of profits distribution. At the end, it is briefly presented the matter of the action pro socio as an instrument of judicial protection and its relation to the contract’s dissolution.
