Abstract

The study aims to analyze the important role that the affection is represented in legal discourse as legitimizing element of familys. The text display a critical confrontation of the romantic vision of the family based exclusively on love and affection. It discusses the idea that the current family transcended teh eudaimonistic design, in which only search the individual happiness and affection for solidarist conception, as the core of cooperation. It is argued that the family is essentially dynamic, and thus can take countless contours in order to satisfy various interests, which guarantees autonomy and freedom in the choice of the form of family unit that suits each.
