The expansion of the U.S. product liability law in face of the Restatement (Second) of Torts

Abstract

The paper aims to present the beginning of the development of the U.S. Product Liability Law, from its initial stage to its zenith, caused by the expansion of the indemnification provisions to victims of product defects. A few causes that are to be outlined to explain the expansion of product liability law are the apparent eagerness with the strict liability regime, the attention to the nature of product defects and the application of the provisions contained in the Restatement (Second) of Torts.
