Abstract

The purpose of this study is to provide
a comparative perspective regarding the various meanings attributed to the concept of private autonomy. The paper is particularly concerned, on the one hand, with determining whether private autonomy has a univocal meaning across contemporary legal systems and, on the other, whether it provides the sole ground for the enforceability of private contracts.
