(Lecture delivered at the hall of the Brazilian Bar Association, at the Palace of Justice, on August 12, 1927)
Keywords:
Brazilian law, Family, Property, Standardisation of lawAbstract
This lecture, which was turned into an article published in 1927, presents the relationship between Public Law and Private Law in Brazil from 1827 to 1927, marking the 100th anniversary of the creation of law schools in the country. The article discusses key political and legal developments during both the Monarchy and the Republic, highlighting the Imperial Constitution (1824) and the Civil Code (1916). The text has three central topics: Constitutional Law, family relations and property rights. It describes how legal innovations in the 1910s and 1920s regulated labour relations, the evolution of marriage (although it condemns divorce) and the socialisation of property rights. It also argues for the legislative renewal of Commercial Law. Finally, it presents the expectation of the standardisation of Private Law in the American nations.
