Abstract

The paper explores a decision from the Indian Supreme Court, in a context that opposes religious and legal problems. As a reference the practice of a unilateral framework of divorce, as husband privilege. The paper discuss the Indian Supreme Court self-restriction on the subject, postponing the final decision to the Legislative and the Executive.
