Abstract

The protection of investor´s confdence in Brazil is very low. Despite the objective good faith and their obligation of information, clarifcation and advice having a legal basis in the Consumer Law and the Civil Code, fnancial institutions and agents rarely take over responsibility for omission or for providing false or inaccurate information to investors in the fnance market. A comparative study with German Law shows that there is still much to do in this complex and potentially harmful area.
