The Pen and the Paintbrush: Pedro Américo’s Draft on Copyright Law and the Dialogue between Politics, Law, History and Art

In Brazil, the concern of the Legislative Power with what we call copyright took shape for the first time in 1856, thanks to a bill drafted by the congressman Aprígio Guimarães. After this initiative, many others are given, among which the one led by Pedro Américo, distinguished Brazilian painter who became member of the national Parliament in 1890. It was as a representative of the Republican Party that the author of the painting “Independence or Death” submitted to the Parliament an innovative proposal on copyright matters. It is about this draft that we try to deal here in order to report its progress and establish a dialogue with the current Brazilian legislation on copyright.
