Abstract

This article aims to analyze the publishing  contract, concerning the historical evolution  of copyright, its legal nature and evolution  of Brazilian legislation towards it. The recognition  of author’s moral rights as a central foundation  of copyright system will be highlighted  when analyzing the concept and characteristics  of the publishing contract, as well as the obligations  and rights of the author and the editor.  Matters of liability shall also be analysed, based in axiological conformation of the copyright system.  In this sense, the paper intends to propose  amendments to the Brazilian Copyright Act.
