Abstract

This essay analyzes the loss (waste) of time by tort or product/services malfunction victims, defining whether or not such loss of time constitutes a compensable loss. It inquires whether or not the victim’s time is compensable and under which circumstances. It also compares the liability due to loss of useful time with liability due to privation of use of an asset. It summarizes current literature on the subject, comments some recent decisions issued by Brazilian courts that have approached the matter and presents a brief outlook of how the subject is treated abroad. After concluding that time is a compensable asset, this paper analyzes when compensation is due, proposes certain parameters to be used and comments on the positive behavior incentives generated.
