Cultural assets and a non domino acquisition

Abstract

The present paper seeks to analyse the use of doctrines related to a non domino acquisitions of so called cultural assets (beni culturali), as defined on the Italian Urban Codex (Codice Urbani), even though such meaning has not been widely adopted by the doctrine. Then, the paper analyses the international circulation of such cultural assets, the evaluation of existence of good faith, a legitimate deed, and thoughts regarding the transfer of possession when acquiring cultural assets, specially when such situations unfold in case of non domino acquisitions.
