The activation of hardship clauses in rural land lease agreements: feasibility and relevance

This article examines the activation of hardship clauses in rural lease agreements. The research problem centers on the general difficulty of renegotiating rural contracts in light of unforeseen changes occurring after their execução. The study aims to evaluate the validity and appropriateness of such clauses in rural lease agreements, while also identifying their potential advantages and drawbacks. The research is theoretical, based on a bibliographical review, and adopts an inductive approach to support its analysis. The findings suggest that hardship clauses can effectively redistribute risks and financial burdens, thereby avoiding third-party intervention in the contractual relationship. The article concludes that hardship clauses are both relevant and compatible with rural lease agreements.
