Abstract

This present paper seeks to understand the Brazilian Civil codification process, approaching the elaboration difficulties of a Civil Code to the need of solving, yet in 1850, economical key issues of the Brazilian 19th century, in special, an indication for the end of slavery, a protection to land ownership, as well as guarantees for businesses transactions. Considering the solutions adopted in 1850 (the extinction of slave trade, codification of the Brazilian Land Act – Lei das Terras – and the Commercial Code – Código Comercial), the civil codification process became a secondary issue on Brazilian political debate, which could justify its belated conclusion, already on the 20th Century
