Abstract

This paper intends to shed light on the history behind the current legal debate around article 426 of the Brazilian Civil Code. The paper analyzes Roman sources related to what is currently known as “succession pacts”, drawing specific attention to the reasons brought by Roman jurists and Emperors in order to either allow or prohibit such pacts, starting from the Classical Rome until the compilation of Justinian. Finally, the paper presents conclusions based on the sources that have been examined, while comparing them to the standard and current scholarship on the Roman legal framework of “succession pacts”.
