Inheritance distribution: legal standards and right of preference

Abstract

The study aims to analyze the legal standards and the applicability of the right of preference in inheritance distribution, currently basically regulated by article 648 of the Brazilian Civil Procedure Code (CPC) and article 2017 of the Brazilian Civil Code (CC). In the foreground, the template for the succession sharing outlined by the CPC and the CC is investigated, focusing on the guidelines of the role of art. 648 of the CPC: maximum equality, prevention of future disputes and comfortable share. Subsequently, it is questioned whether, although in the excerpts of arts. 647-658 of the CPC and arts. 2013-2022 of the CC there is no express allusion to the existence (or not) of the right of preference, there would be preference rules applicable to. It is concluded that the national legislation works with legal rules of preference that can be invoked for its adapted application in the inheritance distribution, respecting the general standards established by law.
