The use of technology in order to solve family law disputes and the “Amica” service for online settlements aided by artificial intelligence

This article explores disruptive technology resources, such as AI, to improve access to justice through online negotiation, especially by means of “Amica”, an innovative service established by the Australian government in 2020. The following chapters address the requirements to use the platform and the characteristics of its negotiation procedure, in order to shed light on the intersection between technology and dispute resolution in its usage. The authors conclude that AI is important to ODR and its implementation is an adequate alternative for divorcing couples to reach agreements regarding parenting arrangements and less complex property settlements. A comparative analysis of the measures adopted in this country and the ones adopted in Brazilian reveals that in order to consider the advantages of employing such technologies to facilitate access to justice it is necessary to address the existing digital divide and educational deficit, as well as the dangers concerning data abuse and misuse.
