Rivalry, unfair competition and its new paradigm

Abstract

This paper is the result of a two year investigation at the Department of Private Law (University of São Paulo, Brazil) between 2019 and 2021, which mainly focused on the diferences concerning rivalry and unfair competition concepts. In this sense, the paper analyzes the risks involving the intersection of principles and regulations of Private Law and Corporate Law, which may reflect on conflicts regarding notfor- profit legal entities such as political parties, foundations (of civil law tradition) etc. Finally, the paper focuses on the new paradigm of unfair competition and free-riding behaviour in the Brazilian legal system.
