Liability in face of internet content posted by its users: an analysis based on comparative law, the Brazilian internet civil framework and debates in higher courts

Abstract

The paper aims to compare and contextualize the hypothesis of liability of website operators that allow posting (texts, photos, videos) by third parties on the internet. In Brazil, such situation is covered by Article 19 of Law 12,965/2014 (the Brazilian Civil Rights Framework for the Internet – Marco Civil da Internet), which determines that a website operator can be accountable for damages when it decides to push back a court order. Based on the comparative method between Brazilian and foreign laws regarding the theme, the paper also takes into account the recent discussions held by Brazilian higher courts.
