The horizontal effects of fundamental rights in private internet agreements: the problem of content moderation in social networks in Brazil and Germany

The paper investigates how Courts in Brazil and Germany evaluate the theory of horizontal effects of constitutional rights in judicial cases related to content moderation in social networks. Regarding Brazilian law, it claims that it is not clear whether the doctrine of direct horizontal effects is indeed in line with the case-law of the Federal Supreme Court. In German law, on the other hand, Regional High Courts and the Bundesgerichtshof are continuously taking fundamental rights as canons for interpreting contractual agreements between individuals and social networks. In both jurisdictions, the interpretation of the terms and conditions of use of platforms presents methodological challenges for the theory of horizontal effectiveness.
