Good faith acquisition in the 1995 UNIDROIT Convention on Stolen or Illegally Exported Cultural Objects

Abstract

The illicit trafficking of cultural objects is a complex and mainly transnational phenomenon, and it poses a challenge that requires a strong response from the international community. Despite the 1970 UNESCO Convention’s advances in this realm, the efficient implementation of some of its provisions has been hindered by many obstacles, especially due to conflict of law issues. Amongst those, the question of good faith acquisition of a stolen or illegally exported cultur-al object stands out, and this matter is addressed in different ways by national legal systems. It was the 1995 UNIDROIT Convention that sought to solve this problem. Taking this context into account and based on the analysis of the cases Elicofon and Winkworth, this work aims to shed light on this topic, paying special attention to the harmonising solution set forth by the 1995 Convention: the concept of due diligence.
