Mandate agreement: typology and features in Brazilian private law

Abstract

From its Roman origins, as well as keeping track of the perspective of comparative law, this article investigates the outlines of mandate agreement in civil law, distinguishing it from representation and procuration. The three profiles of this contract in contemporary Brazilian law are then presented: the mandate with representation, the mandate without representation and the mandate in rem suam.
