Abstract

The emergence of new commercial figures, the role of the company in society and the globalization of markets, force us to rethink the contours of current commercial law. The Code, which until a few years ago was the center of the legal system, seems to have been outdated due to the dynamics of current trade. In this paper, the forms of trade regulation are questioned since its emergence, concluding that these activities must be regulated by agile and flexible rules, which enable the reduction of agents’ transaction costs.
