Pure Economic Loss, Comparative law

Abstract

The article discusses the theme of pure economic loss, from a comparative law perspective. The subject, very present in foreign doctrine, but also in the jurisprudence and even in the legislation of some countries, is still almost unknown among us. Purely economic damage means damage that does not affect the tangible good of others neither their psychophysical integrity. It is purely pecuniary damage: loss of money, economic advantage or increased expenses. The expression “pure” or “purely” is indicating that the theme does not cover those other economic damages that are the consequence of damage to things or to the person, as with the similar but not identical figure of lost profits. The dialectical method was used, using basic bibliographic research, aiming at its application, with a qualitative approach.
