This article is about the intersections between Brazilian Private Law and Brazilian Commercial Law used as basis to a qualification of small business in Brazilian legal system. It is a study that used doctrinal and case-law sources. This investigation develops an analysis of the commercial elements used to formulate the legal concept of small business according to Brazilian Small Business Act (Lei Complementar 123/2006), passing through an analysis of the historical roots of its creation. In this line of reflection, the article searches the constitutional nature of small business’s legal protection. The study also proposes to show how legal concepts in the Brazilian Civil Code interact with the Small Business Act and the Federal Constitution of 1988, turning its principles into concrete rules.
