Abstract

The present text examines a decision issued by the Brazilian Superior Court (STJ) on a case in which the negotiable instruments law was applied to the factoring. The debate was based on two main questions: by which means the transmission of the credits to the factoring company is operated, by endorsement of instrument or by assignment of credit? Is it possible to assert a personal defense against the factoring company?
