Abstract

This paper discusses the regulation of contract farming arising from Brazilian Federal Act 13,288, of May 16, 2016. By using analytical method, along with research on past decisions and bibliographical research, the contract is then defined and characterized as an agrarian and farming contract. Subsequently, the paper analyzes the legal outcome of such Act, especially in terms of concepts and principles, contractual rules and the formation of collegiate bodies and transparency mechanisms. The results demonstrate the legislator chose to establish conduct rules which are opposed to the mandatory rules that govern typical agrarian contracts set forth on Federal Act 4,504, of November 30, 1964, and also that the lack of specific regulation causes such Act to be regarded as insufficient, both in terms of promoting collegiate bodies and curbing economic dependence abuse.
