Evolution of Private International Law as demonstrated by the analysis of treaties regarding international recovery of child support and other forms of family maintenance

Abstract

This article relies on the concrete example provided by the main international and regional treaties regarding the recovery of child support and other maintenance obligations in order to demonstrate the evolution of Private International Law. The rules inserted in each of those treaties are examined in order to ascertain the gradual development of seven modern trends of the subject, which are related to the pluralism and the idea of justice that shape the discipline nowadays. At last, the compatibility of the Brazilian legal order with these international treaties and the above-mentioned trends is also studied.
