Extension and limits of suppressio and surrectio in the multi‑ownership condominium

Abstract

The growing jurisprudential application
of the figures of suppressio and surrectio in the
multi -ownership condominium shows the potential
that both have in the consolidation of long -term
de facto situations in the relations between the
co-owners, along with the eventual derogation of
certain punctual normative contents of the condominial convention. Also, some quantitative data,
which were generated from the jurisprudential
research carried out in the range of the São Paulo
State Court of Justice will be shown, seeking out to
elucidate the most affected aspects of the multi-
-ownership condominium.
