The participation of the Prosecutor in the guardianship of judicially disabled

Abstract

From the perspective of the institution of guardianship of judicially disabled, this study proposes to examine the contribution of the Public Prosecution in contemporary society and, especially, in civil lawsuit especially. Under this approach, this paper intend to research the Parquet’s role in the procedure for voluntary jurisdiction in cases of interdiction, particularly about its legal standing and the defense of incapables – what seems mostly like litigation. Based on case-law decisions and doctrine this work addresses the limits and the Public Prosecution’s scope of activity in guardianship of judicially disabled.
