Transaction as a typical contract: instrument of self-regulation of conflicts between individuals

Abstract

The work aims to analyse the most important points of the transaction as typical juridical act, from the recognition by the Civil Code of 2002, of the contractual nature of this figure. Since the transaction is a legal instrument of great economical role, and of a relevant theoretical nature, whose main purpose is to serve for the regulation of conflicts between private individuals, through reciprocal concessions, it is important to highlight and examine their theoretical particularities in the context of contracts, and to verify the development given to it since the promulgation of the Civil Code of 2002.
