Abstract

The author analyses the reception of
Savigny’s methodology of interpretation of norms in Brazil and Portugal. This methodology can be characterized as being historic, strongly bound by systematic thinking, and, above all, as one which does not require the utilisation of “objectives” for the process of interpreting norms. The author shows how far Savigny’s methodology has influenced the process of interpretation in Brasil and Portugal and distances himself from the approach of considering “objectives” in the process of interpreting norms (which was introduced by Jhering).
