Abstract

The aim of this paper is to demonstrate the inaccuracies in the legal literature that examines civil liability arising from the breach of a promise to marry based on Article 186 of the Civil Code, as well as Court decisions that consider it as a regular exercise of rights. Both the legal literature and case-law disregard the provisions concerning pre-contractual liability, especially those related to unfair breach of negotiations, which protects the legitimate expectations of the bride and the groom on the basis of Article 187 of the Civil Code.
