Abstract

This paper analyzes the development of the Brazilian property transfer system from a comparative perspective, remounting its origins in Roman Law and later the creation of specific property transfer systems in Germany and France, as forerunners to the development of the Brazilian system, as well as in many others around the world. The paper exposes some of the criticism offered by Brazilian legal scholars at the time of the development of the Brazilian system, which is particularly unknown to contemporary scholars, whether Brazilian or foreign. Essentially, how does the seller of property shall duly perform his obligation?
