The legal and cultural aspects of plagiarism in academic writing

This paper offers legal and cultural elements for the debate on plagiarism in academic writing. It analyses copyright law and explores plagiarism as a result of a culture that treats knowledge as a “commodity.” The text is based on literature review and judicial decisions and is divided into two parts: the first one deals with plagiarism under the author’s perspective and, in this context, argues the impossibility of understanding plagiarism as an involuntary act. The second part deals with plagiarism in academic writing, presenting brief historical considerations on the academic background and describing how plagiarism is associated to the technological mediation operated by the information and communication technologies (ICTs) and market society.
