Abstract

This study focus on Article 226 of the Brazilian Constitution. It examines the meaning of the “special protection” mentioned in the opening provision of that provision. The study is divided into four parts. First, before engaging in a any legal analysis, it explores the underlying anthropological motivations. The second part addresses the treatment of the issue in the international context, followed by an examination of how it has historically been approached in Brazil. The final section considers the current status of the topic within the contemporary Brazilian Constitutional Charter. Does the expression “special protection” entail concrete legal consequences? The study reviews how this concept has been interpreted in legal scholarship, mapping different positions. It considers the potential existence of a protective framework for the family and proposes the creation of a national forum to promote it. The study is mainly based on legal rules, while still acknowledging the value of complementary approaches. Ultimately, it argues that the family, as both a legal and social entity, must receive careful attention from all sectors of the State in order for this constitutional directive to be realized.
