Abstract

This article is about the interpretative possibilities of the general clause of strict liability of the entrepreneur for the products put in circulation. Despite the innovation in this statutory article, it is considered by many authors a simple copy of the model from the strict liability by the fact of the product from the Consumer Code. In this context, this article shows the distinction from the regime of civil responsibility based in the facts of products and the regime of civil responsibility from the entrepreneur for the circulation of products, dealing with the effects and interpretative possibilities from the art. 931 from the Civil Code.
